Representations: Litigation & Alternative Dispute Resolution: • Defended SMIC against TSMC in a trade secrets/breach of contract case involving billions of dollars of damages claims: drafted document requests, interrogatories, and discovery responses; conducted document review; assisted offensive and defensive depositions; worked on expert declarations on ion implantation and design rules; defeated Motion for Preliminary Injunction by TSMC (Alameda County Superior Court, Case No. RG-06-286111). • Defended Affymetrix against MIT and E8 Pharmaceuticals in a patent infringement case involving hundreds of millions of dollars of damages claims: served as the lead associate and managed all aspects of the case from the initial disclosure to the close of fact discovery; formulated claim construction and case strategies; interviewed Nobel Laureate Kary Mullis; prepared the partners for the depositions of Professor David Housman and Professor Eric Lander; won Motion to Dismiss by Affymetrix (U.S. District Court for the District of Massachusetts, Civil Action No. 08-cv-11132). • Represented UTStarcom in an FCPA invesitgation initiated by the U.S. Department of Justice. • Avoided an AAA arbitration and resolved a licensing dispute with Eastman Kodak Company involving millions of dollars of claims for overpaid royalties. • Resolved a breach of contract claim with Digital River (U.S. District Court for the District of Minnesota, Civil Action No. 11-cv-03628). • Settled a patent infringement case with JVC Kenwood represented by McKool Smith involving 14 patents within four months of case filing (U.S. District Court for the Central District of California, Civil Action No. 12-cv-03662). • Recovered over half a million dollars in unpaid royalties from a top PC and device manufacturer through AAA arbitration. Commercial Transactions: • Reviewed thousands of agreements of all types signed by ArcSoft, a private software company based in Fremont. • Negotiated and closed multi-million dollar services agreements and software licenses with Dell, Motorola, Nokia, Qualcomm, and Broadcom, respectively. Representative Patents Prosecuted: • United States Patent obtained by Liaoteng Wang, Patent No. US8,238,243, “System and Method for Network Optimization by Managing Low Priority Data Transfers.” Issued on August 7, 2012. • United States Patent Application drafted by Liaoteng Wang, Publication No. US2012/0120186A1, “Front and Back Facing Cameras.” Published on May 17, 2012. Representative Trademarks Prosecuted: • PERFECT365, United States Trademark obtained by Liaoteng Wang, Registration No. 4169330, filed on August 24, 2011 and registered on July 3, 2012. • LECAM, United States Trademark Application prepared by Liaoteng Wang, Serial No. 85800156, filed on December 11, 2012 and pending. General Corporate Counseling: • Experimented with a corporate inversion from California to Cayman Islands through a reverse triangular merger to enable potential future listing on Hong Kong Stock Exchange and Taiwan Stock Exchange. • Assisted in Series C Financing participated by Intel Capital and Tudor Ventures. • Assisted in international tax planning.
